Weakest suffer twice: US jails child victims of sex trafficking

The FBI estimates that each year more than 100,000 underage American girls are exploited for commercial sex.

Underage prostitution in the US is organized crime's third biggest money-maker after guns and drugs. But the kids get blamed instead of the criminals. Young girls are put behind bars for walking the streets, with no offer of rescue or help.

Yet for the home country, the FBI estimates that each year more than 100,000 underage American girls are exploited for commercial sex. The average age is 13 years old. But the usual treatment the children get, when arrested, is either jail time or probation.
In the US, prostitution laws do not exempt minors from prosecution. The Office of Juvenile Justice and Delinquency Prevention reported 1,600 juveniles were arrested for prostitution within just one year.

But lawyers say in the US, the paradox of the system is that the children are prosecuted for crimes for which they cannot legally give consent.
We say that this child is a victim and yet we send them to jail. Somewhere along the line, there’s something wrong with that and we need to take a look at ourselves and a look at the fact that we have made detention, and law enforcement, and the criminal justice system, and juvenile justice system a default setting for what happens to these kids. And we just kind of lock them up and shove them away. And that’s the end of our response to these issues, this system. We wanna make sure that these kids are treated as victims,” says Raychel Lloyd from Girls Educational and Mentoring Services.
But treating the victims and providing for their recovery requires funding.
There’s no federal money for US victims of trafficking,” says Tina Frundt who works with a non-profit group in Washington, which helps the children to get their lives back providing them with housing and medical treatment. She herself was trafficked at the age of 13.

Tina says it is easier for the government to label the children as prostitutes, charge them and send them to detention centers, rather than fund shelters and invest in their future.
“There’s not enough housing for sex trafficking victims at all. So what they’re saying is that for their safety we will arrest them and put them in jail. Then we charge the victim. We don’t put rape victims in jail, why would we put victims who were trafficked in jail?” asks Frundt.
Almost all of the victims of child trafficking remember being constantly raped and abused both by pimps and clients.
Many of the young people we served have been incarcerated and charged as an adult under the age of 16. So they have this lengthy 15, 20, 30, 40 arrests both as a juvenile and as ‘an adult’ for prostitution. When they go to apply for public housing, they are not eligible for that. When they go to do certain employment, that pops up in a background check and they are booted out of an employment training program,” says Raychel Lloyd.

The past of such children is already scarred as it is. And the non-profit organizations that help victims of sex trafficking say by prosecuting the children and by not investing in their recovery it is the government that scars their future.

I think it's insane to suggest that children have less protection from sexual exploitation today than in the past. The laws against all sorts of exploitation have been strengthened and new laws have been passed.

And they are being more vigorously enforced. Things that were perfectly legal before the 80s, are now felonies. And should be. Kids who are forced into prostitution would seemingly be treated as victims. I know that Texas treats them as such. If there is no evidence that they were forced, then it treats it as juvenile crime.

Which seems right to me. Even if kids can't legally consent to anything, they can still be guilty of criminal activity, assuming that they do so on their own. Do you have some checkable data on this?

I worked with a 15 year old who was forced into by her mother's pimp. The perverts that are in this "business" are very crafty in their ways and around varying State Laws. For example: the girls worked truckstops in one State. Once they got busted by the Police, the pimp would them send them just over the State Line into another. When they ran out of neighboring States, the pimps networked to move the girl far far away from her original State and then the same cycles repeated. That particular girl luckily was not already hooked into crack, cocaine, meth, or heroin.

It is a problem. It does still exsist. It makes me sick to my stomach that there are so many deviants out there who turn a blind eye to the devastation it causes and the evilness of the acts upon "minors".....yet there is not a supply of customers it seems.

What good are laws if we have a culture that promotes out of wedlock sex, pornography and a "if it feels good, do it" mentality?

"Men, in a word, must necessarily be controlled, either by a power within them, or by a power without them; either by the Word of God, or by the strong arm of man; either by the Bible, or by the bayonet."

The more morally corrupt a society becomes, the more laws are needed to protect the innocent. Unfortunately as Naz has shown, the innocent are still falling prey to those that aren't controlled by the Bible.

The more morally corrupt a society becomes, the more laws are needed to protect the innocent. Unfortunately as Naz has shown, the innocent are still falling prey to those that aren't controlled by the Bible.

"Our study suggests that the more heterosexual men, especially less educated heterosexual men, watch pornography, the more supportive they become of same-sex marriage," Indiana University Assistant Professor Paul Wright told Secrets.

What good are laws

They allow the police, FBI, etc. to arrest people who abuse children by passing child porn around on the net, and so on. It also gives them the tools to locate and crush pedophile rings who pass kids around like toys. Didn't used to be that way. I figure it's a good thing. We'll just have to disagree on that.

That's the point. It took kids out of the equation. There used to be a lot more of that going on. Now, it's not safe. And that's a good thing.

Overall cases of child sexual abuse fell more than 60 percent from 1992 to 2010, according to David Finkelhor, a leading expert on sexual abuse who, with a colleague, Lisa Jones, has tracked the trend. The evidence for this decline comes from a variety of indicators, including national surveys of child abuse and crime victimization, crime statistics compiled by the F.B.I., analyses of data from the National Data Archive on Child Abuse and Neglect and annual surveys of grade school students in Minnesota, all pointing in the same direction.

From 1990 to 2010, for example, substantiated cases of sexual abuse dropped from 23 per 10,000 children under 18 to 8.6 per 10,000, a 62 percent decrease, with a 3 percent drop from 2009 to 2010, according to the researchers’ analysis of government data. The Minnesota Student Survey charted a 29 percent decline in reports of sexual abuse by an adult who was not a family member from 1992 to 2010 and a 28 percent drop in reports of sexual abuse by a family member. The majority of sexual abuse cases involve family members or acquaintances rather than strangers, studies have found.

At the same time, the willingness of children to report sexual abuse has increased. In a 2008 survey, Dr. Finkelhor, director of the Crimes Against Children Research Center at the University of New Hampshire, found that in 50 percent of sexual abuse cases, the child’s victimization had been reported to an authority, compared with 25 percent in 1992.

In essence The Barbarian has no problem with a huge out of control fire, in fact he has no problem with people pouring gasoline on it while it's burning, he's just glad that a Fire Department is available to respond after the damage is done.

NEW YORK -- Reports of child abuse and neglect have dropped nationwide for the fifth consecutive year, and abuse-related child fatalities also are at a five-year low, according to new federal statistics.

The latest annual report from the Department of Health and Human Services, released Wednesday, estimates that there were 681,000 cases of child abuse or neglect across the nation in the 2011 fiscal year. That's down from 695,000 in 2010 and from 723,000 in 2007.

"We have made excellent progress over the past five years," said George Sheldon, HHS acting assistant secretary for children and families. "But what this report tells me is that we still have 681,000 children out there who need our help."
