A government has every right to prosecute anyone for conduct that the government has not consented to, whether that conduct is done in public or in private.

You do understand that your conduct is subject to consent by the government, right?
If the government does not consent, then your conduct is illegal.

Amendments are the key. And they can be voted in and recognized as extending or shrinking "the law of the land."

I do agree that our government is no longer responsive or as nimble and flexible as it once was.

Thomas Jefferson had a lot to say about the necessity for change and revolution when our system no longer works for us.

As late as 1967, 17 states had laws that outlawed interracial marriage - often these laws were based on "religious" grounds.

It was the Supreme Court, not Congress, that established the right of every American's right to marry who they want - regardless of race.
