Scalia is wrong. The preamble to the Constitution says, "We the people of the United States, in order to form a more perfect union, establish justice, insure domestic tranquility, provide for the common defense, promote the general welfare, and secure the blessings of liberty to ourselves and our posterity, do ordain and establish this Constitution for the United States of America.

Since it is now an established scientific fact that human life begins at fertilization, the unborn are a part of "ourselves." And giving an innocent person the death penalty violates the goal in the Constitution's preamble to "establish justice."

Therefore, Scalia is wrong.

Judges are to do the job they were asked to do. Interpret the Constitution. If we get judges that do that (which are conservative by definition), then we would not have judges making law today.
McCain would not nominate judges who define the word "ourselves" in the Constitution's preamble to include the unborn, therefore those nominees can be as "conservative" as possible and still be against making abortion illegal.
