I've seen several commentators say both the left and the right are prematurely panicking or rejoicing, that nothing at all may change re: Roe v. Wade because the Court relies so much on precedence. Time will tell.

For some balance to Shapiro's commentary:

Overturning the landmark 1973 ruling, as seems more and more likely, might take away a powerful tool for energizing conservative voters — and it might motivate liberal ones.

^ This is why Trump chose Kavanaugh. He needs to make sure that the Supreme Court will side with him over any lawsuits and legal matters ... especially the Russia Investigation. This is on the same level of a defendant being allowed to pick the jurors and judge who will preside over their case.

Yep. Also, I think it was NBC this morning who quoted a source as saying that prior to his resignation, negotiations had been going on for months between Kennedy and Trump. If corroborated, it would be a disturbing development.

It is imperative that the American people not acquiesce their grave responsibility but forcefully press their elected Senators and the news media to question and hold fully accountable this nominee for his viewpoint on vital national security issues such as the Constitutional power to declare war, Habeas Corpus, warrantless detention, warrantless surveillance, torture, rendition, national security letters, and the constitutionality of Continuity of Government (COG) and covert operations of the intelligence agencies.

Does the judicial nominee hold that the Constitution established a federal decentralized compact or republic of sovereign independent states granting explicit delegated powers to the general government for specific purposes while retaining their reserved powers for themselves? Or does the United States simply pose as a sham elective democracy but is in fact a militarized despotism with actual power residing in the hands of a secret oligarchy that is arbitrary, capricious, and unaccountable, a tyranny lacking transparency, justice, or restraint?

Kavenaugh has some libertarian tendencies (which do have conservatives concerned about him), but he also has some tendencies to favor the state over individual liberties:

Libertarian-leaning Rep. Justin Amash (R*–Mich.) isn't happy with President Trump's choice of Brett Kavanaugh to replace Associate Justice Anthony Kennedy on the Supreme Court.

The D.C. Circuit Court judge is not a staunch defender of Fourth Amendment protections that prevent improper searches and surveillance by the government, Amash said in a tweet:

One person who knows both men remarked on the affinity between Mr. Trump and Justice Kennedy, which is not obvious at first glance. Justice Kennedy is bookish and abstract, while Mr. Trump is earthy and direct.

But they had a connection, one Mr. Trump was quick to note in the moments after his first address to Congress in February 2017. As he made his way out of the chamber, Mr. Trump paused to chat with the justice.

“Say hello to your boy,” Mr. Trump said. “Special guy.”

Mr. Trump was apparently referring to Justice Kennedy’s son, Justin. The younger Mr. Kennedy spent more than a decade at Deutsche Bank, eventually rising to become the bank’s global head of real estate capital markets, and he worked closely with Mr. Trump when he was a real estate developer, according to two people with knowledge of his role.
During Mr. Kennedy’s tenure, Deutsche Bank became Mr. Trump’s most important lender, dispensing well over $1 billion in loans to him for the renovation and construction of skyscrapers in New York and Chicago at a time other mainstream banks were wary of doing business with him because of his troubled business history.

Well, so Kennedy was trying to do a favor for someone he likes, and perhaps made a deal with Trump.

The only thing that's suspicious about that scenario, is that Trump never keeps his agreements. If this turns out to be true, Kennedy would be the first guy who ever trusted Trump and didn't regret it later.

I don't even know if this is illegal, but it kinda smells. Assuming Kennedy trusted Trump enough to do this, which seems unlikely.

If Kennedy timed his resignation to be before the midterms and during Trump's tenure with an assurance from Trump that Kavenaugh would be his replacement, then any vote he makes on anything Trump-related brought before the court would be suspect.
